(ANGOLA) - Steuben County Clerk Shelly Herbert says her office is now issuing marriage licenses to all couples including same sex couples. The change came a day after Steuben County Attorney Don Stuckey advised Herbert in an e-mail that her office should not issue marriage licenses to same sex couples until a ruling is received on the request for a stay of a federal judge's order which threw out Indiana's ban on gay marriages. The Indiana State Attorney Generals office was seeking that stay through their appeal of the judge's ruling.
Herbert says Stuckey talked with other county attornies on Thursday and after a re-evaluation, she was told to go ahead and issue the same sex marriage licenses.
She said as of early Friday afternoon that four same sex couples from Steuben County have gotten marriage licenses from her office. Two women were the first ones to get a license. Two men from Fremont were given a license after being denied on Thursday after Stuckey's initial advisement. The two other same sex couples were men.
There is no waiting period to get hitched in Indiana after a couple gets thier license.
